Terms of Service

These Terms govern your use of NexHost hosting, ProperInbox business email, and Nextsend transactional email — all operated by Nexthome Labs.
01Agreement to these terms
These Terms of Service ("Terms") form a binding agreement between you and Nexthome Labs ("Nexthome Labs", "we", "us") governing your access to and use of NexHost hosting and deployment services, ProperInbox business email, Nextsend transactional email, and any related websites, dashboards, CLIs, APIs, and documentation (together, the "Services").
By creating an account, deploying a project, creating a mailbox, or otherwise using the Services, you accept these Terms. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to that organization.
02Accounts and eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Services. You agree to provide accurate registration information, keep it current, and maintain the confidentiality of your credentials, API tokens, and one-time PINs.
You are responsible for all activity under your account, including activity by users you invite, mailboxes you create, and tokens you issue. Notify us immediately of any unauthorized use.
03The Services
NexHost lets you upload or push projects, build supported frameworks, publish versioned releases, and route custom domains with TLS. ProperInbox provides mailboxes on your own domains with webmail, IMAP, and authenticated SMTP. Nextsend provides transactional email delivery through API tokens and a managed SMTP gateway.
We may improve, change, or discontinue features over time. We will provide reasonable notice for material changes that reduce functionality you pay for.
04Your content and your responsibilities
You retain all rights to the code, files, releases, domains, email content, and data you submit to the Services ("Customer Content"). You grant us a limited license to host, store, transmit, and display Customer Content solely to operate the Services for you.
You are solely responsible for Customer Content and for complying with applicable law, including intellectual property, export, privacy, and anti-spam laws. You must follow our Acceptable Use Policy.
05Plans, billing, and refunds
Paid plans are billed in advance on the cadence shown at checkout. Prices are listed on our pricing page and may change with notice before your next billing period. Taxes may apply.
Except where required by law, fees are non-refundable. If we terminate your paid plan without cause, we will refund the unused, prepaid portion of the current term.
06Acceptable use and suspension
You may not use the Services to break the law, infringe rights, distribute malware, send spam, or abuse infrastructure. We may suspend or throttle projects, mailboxes, domains, or sending domains that violate these Terms, harm other customers, or create security or deliverability risk, and we will notify you when practicable.
07Intellectual property
The Services, including our software, brand, logos, and documentation, are owned by Nexthome Labs and protected by intellectual property laws. These Terms grant you no rights to our trademarks except as needed to use the Services as intended.
08Disclaimers
The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Our Service Level Agreement describes the specific availability commitments we do make.
09Limitation of liability
To the maximum extent permitted by law, Nexthome Labs will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our aggregate liability arising out of the Services is limited to the amounts you paid us in the twelve months before the event giving rise to the claim.
10Termination
You may close your account at any time from the dashboard or by contacting support. We may terminate or suspend access for breach of these Terms, non-payment, or legal requirement. On termination, your right to use the Services ends; we retain Customer Content for a limited grace period described in our Privacy Policy, after which it is deleted from active systems and later from backups.
11General
These Terms are governed by the laws of the jurisdiction in which Nexthome Labs is established, without regard to conflict-of-law rules. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. We may update these Terms; material changes will be announced through the dashboard or email before they take effect, and continued use after the effective date constitutes acceptance.
